These Terms of Service ("Terms") are an agreement between you and Vanish ("Vanish", "we", "us"), the operator of get-vanish.com (the "Service"). By creating a subscription or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Vanish submits personal-information deletion and do-not-sell/do-not-share requests to data brokers on your behalf, using broker contact information published in official government data broker registries (such as the California data broker registry). Vanish also tracks statutory response deadlines and re-sends requests where appropriate.
What the Service does not do: Vanish does not control data brokers and cannot force any broker to comply. Deletion rights depend on the privacy laws that apply to you (for example the CCPA for California residents, the GDPR for people in Europe, or PIPEDA in Canada), and some brokers may lawfully deny requests in whole or in part, may not respond, or may re-acquire your information later. We do not guarantee that any specific broker will delete your information or that your information will not reappear.
The Service, including the content of the requests we send and any information on our website, is provided for convenience and does not constitute legal advice. Vanish is not a law firm and no lawyer-client relationship is created by using the Service.
You must be at least 18 years old and legally able to enter into contracts to use the Service. The Service may only be used to submit requests about your own personal information (or that of a person for whom you are a legally authorized representative, such as a guardian).
By subscribing and checking the authorization box during signup, you appoint Vanish as your authorized agent for the limited purpose of submitting requests to delete your personal information, requests to opt out of the sale or sharing of your personal information, and reasonably related follow-ups, to data brokers and similar businesses. Some brokers may contact you directly to verify a request. Completing (or ignoring) those verifications is your choice; requests may fail if verification is not completed.
The Service depends on the identifiers you provide (name, email addresses, phone numbers, addresses, other names used). You agree to provide information that is accurate and that relates to you. Submitting another person's information without legal authority, or knowingly false information, is a violation of these Terms and may be unlawful.
You agree not to: use the Service to harass any person or business; submit requests concerning a person you are not authorized to represent; attempt to access other customers' data or dashboards; interfere with or disrupt the Service; or use the Service in violation of applicable law.
We may modify, suspend, or discontinue features of the Service. Requests are sent in batches and timing may vary. We may suspend or terminate accounts that violate these Terms; if we terminate without cause, we will refund a prorated amount of prepaid fees for the unused period.
The Service, including its software, design, and content, is owned by Vanish and its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service for its intended purpose while these Terms are in effect.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANISH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. VANISH DOES NOT WARRANT THAT DATA BROKERS WILL COMPLY WITH REQUESTS, THAT YOUR INFORMATION WILL BE REMOVED FROM ANY SOURCE, OR THAT IT WILL NOT REAPPEAR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANISH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. VANISH'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO VANISH IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED BY LAW.
You agree to indemnify Vanish against claims arising from your breach of these Terms, including submitting information about a person you were not authorized to represent.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Courts located in British Columbia have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court, and nothing prevents you from relying on mandatory consumer-protection rules of your place of residence.
We may update these Terms from time to time. Material changes will be announced by email or on the website at least 14 days before they take effect. Continuing to use the Service after changes take effect constitutes acceptance.
